Other Ways of Paying for an Accident Claim

When you win your case, you expect to get your costs paid by the other side. But, the law says that you can only get back those costs which it was reasonable to incur. So if you have conducted your case in a way which is more expensive than another way which was available to you, you may well not get back the cost you have incurred.

So, before you decide on any method of funding your case, you must consider if there is some other, cheaper, way for you. The following is a list for you to think about.

  • Legal Aid - Well, I have said elsewhere that Legal Aid (now called Public Funding) has been mainly taken away from accident claims. But there are still some types of case which could qualify. Very complex, specialised or very high cost cases can still get Public Funding, and if you have such a case then you should take advantage of it if it is available to you. Your solicitor will advise you.

  • Existing Insurance - You may have cover for the legal expenses of a claim through an existing motor policy, or a household policy, or some similar insurance. If you have, then you should use it. You may still be able to nominate your own solicitor to act for you. Me, for example!

  • Trade Unions - Unions often offer not only advice but may pay for a claim. You must check with your Union, if you belong to one, to see if they will help you

    If you have some other, cheaper, way of taking your case then you may not get all your costs back at the end if you do not use it
