Road accidents account for by far the large majority of personal injury claims. And, perhaps not surprisingly, about 95% of them are successful claims. In road accident cases it is usually fairly easy to identify the party at fault.
But there can be complications. What about the driver who collides with you because he swerved to avoid a dog in the road, or a child? What about the driver who has an illness at the wheel, or who's vehicle suffers an unpredicatable fault?
And what about seatbelts, or crash helmets? Do you get nothing, or less, because you weren't wearing one?
And what about accidents caused by the state of the road? Potholes, bad signing, obscured junctions? Perhaps another party such as a local council could be liable?
