How much compensation might I get?
First, you have to win! But if you do, then your compensation is made up in a number of ways.
General Damages - this is compensation for the pain and suffering of your injury. It is impossible to assess without knowing exactly what the injury is. A medical report by a specialist doctor is always obtained to help with this assessment. General Damages can range from just a few hundred pounds for a minor injury, to many thousands for catastrophic injury.
Special Damages - your out of pocket expenses such as loss of wages, medication and prescription costs, travel and phone calls, damaged clothing, insurance excess, hire car expenses etc. Loss of wages usually makes up the major part of this category.
Care costs - technically part of Special Damages, you can claim for the cost of someone (usually a family member) caring for you while you are recovering
Future Loss - Again, some prefer to consider this as part of Special Damages, and technically they are, but they relate to the losses you will incur in the future after the court hearing or settlement, such as future loss of earnings if you are still unable to work
Loss of Employability (my expression!) - if,as a result of your injury, you are at a disadvantage in getting another job, or a job as good as the one you had, then you can claim a sum of money to compensate you for this (called a Smith -v- Manchester award after a case of that name)
Pension Loss - a big claim if you have been off work for a long time, and especially if you contribute to a private pension scheme. Obviously, if you are not earning and cannot pay your pension contributions then the value of your pension will be reduced. You can claim for this.
