Slipping and Tripping Accidents

Tripping up, or slipping and being injured, is probably one of the most common types of accident claim after road accidents and accidents at work. And very often the claim is made against a local authority for failing to maintain the highway or footpath or wherever it was that the accident occurred.

But it may also be the responsibility of a private property owner, or a utility such as a telephone company, or a gas or electricity company or some contractor employed to carry out work on the highway.

The good news about this type of claim is that the other side is almost always insured. The bad news, especially if your claim is against a local authority, is that the law gives them a defence to your claim if they can show that they had, and operated, a reasonable system of inspection and repair of the highway. What is, or what is not, reasonable will depend on the area, the road, the local conditions, and many other factors. So if the local council can show they did inspect and repair the road on which you fell and injured yourself then they may be able to avoid liability to you.
